Employment
The employment department, a part of the larger commercial litigation department, is practised in advising employers and employees on day-to-day and atypical issues such as:
- recruitment procedures (in particular regarding new legislation);
- employee, disciplinary and grievance procedures;
- enforcing restrictive covenants;
- redundancy;
- TUPE;
- sex, race, disability, age and other forms of discrimination;
- bullying, harassment and stress,
- equal pay;
- whistle blowing;
- payments on the termination of employment and compromise agreements;
- service contracts and terms and conditions of employment;
- employment related policies and staff handbooks;
- dealing with claims in the employment tribunal and High Court.
The team excels in both contentious and non-contentious work. Members of the team have specialist retail knowledge and are frequently invited to give seminars. Meet the team
Some of the team's recent work includes:
- advising on a case of sex discrimination and unfair dismissal;
- advising on a case of age discrimination and unfair dismissal;
- advising a PLC on the summary dismissal of its CEO and his wife;
- High Court litigation on a consultancy agreement;
- dealing with an employment tribunal claim involving unfair dismissal, equal pay and sex discrimination; and
- dealing with a preliminary issue in the employment tribunal on the question as to whether an individual is an employee or self-employed.
